1955’s TRIAL… Nothing New Under The Sun

This post concerns a rarely seen film. A powerful film; which may explain why it rarely got shown since its release in 1955. New to home video, it dealt with a topical subject when made. And, sadly, the raw ugly truth it conveys about American life remains topical over 60 years later.

As noted thousands of years ago “What has been will be again, what has been done will be done again; there is nothing new under the sun.” Specific issues may change, but society always remains the same, explosive powder keg awaiting a match, often applied by the very people who trick us into believing they want to help us or lead us. Left and Right will mean nothing if the powder keg blows up. And someone always profits from the blast.

In the film TRIAL, each extreme gets revealed as equally deadly when a town becomes a pressure cooker of conflict over a seeming murder.

The story seems deceptively simple: A sheltered law professor with no experience beyond a classroom gets caught up in the real world – and learns that he knows almost nothing about the real practice of law.  If you think America today with its political opportunists who say one thing but do another, who spread racism for profit in new – this film from 1955 (though set in 1947) will show you that nothing has changed. Including those “tolerant liberals” who, inside, harbor just as much prejudice as any klansman.

All sorts of people get involved in a racially charged murder case for all manner of personal profit. We gradually discover that each character has a personal axe to grind: Holding on to a law professor job. Running for governor. Keeping real estate values high. Remaining police chief. Proving himself above racism. And, most deadly, changing society at any cost. As the story unfolds, each character willingly – eagerly! – turns up the heat under the pressure cooker to further his own needs.

This tension creates a crackling, powerful film about extremists of all sorts. Some elements in the film will seem quaint now, but substitute modern groups like the DNC – who want their way regardless of the consequences – and it still works. What kind of a group will gladly cause horrific damage just so they can proclaim “WE TOLD YOU SO” in order to raise money for themselves?
See what I mean? Still works today.

Opportunists willing to destroy everything and anyone to promote themselves have always operated freely among us. Sometimes they win. Sometimes they get opposed successfully. But first we must know them when we encounter them; something not always so easy to see.  When our passions get roused, when we believe that we can clearly tell the “good” people from the “bad,” then we make ourselves ripe for the picking. We blindly give those with ulterior motives the power to manipulate us.

As the lead character says early on: “I learned a long time ago that when someone says ‘decide right now’ that that’s the time to take your time.” He knows this. Does he do it?

Fundamentally, this film presents a cautionary tale about the difference between knowing the right thing and doing the right thing. Passion and certainty cloud the mind. Whether in the courtroom or the bedroom. This film could easily get set in today’s America, using any “populist” movement in place of that shown from the 1940s. As one character slyly notes, “never trust anyone”. Especially those you consider leaders. You may not really know what goals they have dedicated themselves to.

Little wonder TRIAL never made it to home video till 2014. It says things which even today most people just refuse to hear.

Over the years, Mark Robson proved himself a serious film director and the novelist/screenwriter Don Mankiewicz, son of Herman, had solid credentials as well. Mankiewicz lived a long life, till 2015, so he must have seen the situations in his story played out over and over and over.

TRAIL deceives. This film looks like one thing (another courtroom drama, though an excellent, realistic one) yet, like the events depicted, TRIAL really shows another thing. Glenn Ford performs at his best here as the Ivory Tower lawyer who gets, reluctantly, a taste of the real world. Katy Jurado again plays her patented “suffering Mexican mother,” Rafael Campos appears as the young man who might have… or perhaps not…
Of particular note to me: The cinematography of Robert Surtees. It heightens the proceedings with some genuine surprises. Juano Hernandez as the judge performs up to his usual high standards and excels as a man who faces heat from all sides. Arthur Kennedy snared an Oscar® nomination for playing the smartest man in the room. Perhaps too damn smart…

I consider TRIAL worth seeing to understand much of today’s events, for it presents a warning against extremism when it comes cloaked in virtue. Don’t all extremists believe they alone know the “truth”?

Always question. Always look deeper. Never call anything true for no other reason than it comforts you or reinforces your beliefs.

Do so, and you likely don’t know any more than the people who pull the strings on the puppets want you to know. Consider instead the very real possibility that you, yourself, represent the main puppet.

Keep your eye on the prize and you’ll always lose sight of everything else.

 

A Manhattan Christmas Story

NOTE: Not long ago we received this memory from an unnamed Hell’s Kitchen writer, who assures us that his neighbors all pass him on the street every day… without ever seeing him.

When my kids were little, long before I became what I am now, which is a booze-hound, Christmas time was always something special. It still is special for me ‘cause they haven’t yet closed down all the soup kitchens. The City Fathers missed a couple of soup kitchens in their drive to improve the quality of life in this town by killing off everybody who doesn’t work three jobs and make a hundred grand a year just to pay the rent. So I can still look forward to a meal of turkey with trimmings in some church basement somewhere. Along with the food, the do-gooders give us bums little Christmas presents. It’s nice. Don’t you like getting presents? I do. Last year I got some Old Spice and a soap on a rope. It was green and shaped like a seahorse. I liked the way it smelled. But I accidentally left my soap hanging in the rooming house bathroom down the hall one day and that was the last I saw of it. I don’t know why, but when I found the soap was gone I cried like a baby for two hours. And I never cry. A stupid piece of cheap soap. Archie the bartender who took the pledge was right. Booze does turn your brain to mush.

It was Christmas time and I ran out of money again. A card game this time. Looking for free things to do, I thought it might be fun to see the tree at Rockefeller Center. I usually enjoy the colored lights and all the happy kids giggling and acting like, well, like happy kids. So yesterday, even though I had no money to speak of, I left my room and headed over there. In the daylight you could see that this was one hell of a big tree. Why’d they go kill it? I stood in the part of the plaza they call the Channel Gardens cause on one side is a British building and on the other side is a French building. I was looking at the tree when I noticed this woman with her son. The kid was about six, I guess, no more than seven, and the woman had him bundled all up like he was Neil Armstrong setting foot on the moon even though it wasn’t really so cold out. It couldn’t have been cold cause I was there and I don’t own a coat. That’s why I’m inside today, writing this. Today it’s freezing out. And I don’t own a coat. So this woman has her kid by the hand and says, “look, Lawrence, look at the nice tree. It’s beautiful isn’t it.” She wasn’t so much asking him as she was telling him. Surprisingly, the kid said “no.”

“But it is beautiful,” the mama said, giving the kid a little tap on the back of the head.

“It is not,” the boy insisted.

“Yes it is,” she said, giving him a harder tap.

“I don’t like it.”

“Yes you do!”

This time she gave the kid a clip on the head so hard that I could feel it. The boy wobbled a bit but held his ground.

“It isn’t beautiful! It stinks!”

“It is beautiful!” she says then CRACK! a tremendous shot across the back of the kid’s head. In my day, I seen prize fighters kiss the canvas on less.

“Isn’t mommy right? Isn’t the tree beautiful?”

When the boy didn’t answer, she lifted her hand again.

“It’s so beautiful, mommy,” he said like he really meant it.

“Don’t you just love it?”

“Yes mommy, I love it. I love it.”

“And do you love mommy?”

“Yes. I love mommy.”

She smiled and they went away, both of them happy. I’d hate to be around when this kid gets married. His wife cuddles up to him and coos, “do you love me?” and he says “I love you more than anything” then he proves it to her by belting her right in the sweetbreads. I only hope he finds somebody who’s into that kind of thing. There’s plenty of them out there.

I looked back at the tree, and so help me, now I didn’t think it was very beautiful. Then I cringed, almost feeling a swift hard smack on the back of my head. I turned around as fast as I could and went across the street and down the block to St. Patrick’s Cathedral. I prayed for that kid.

Reading The Riot Act… Fair Warning, Withers.

There is a historical basis for the expression: reading the riot act. The act, known as “An Act for preventing tumults and riotous assemblies, and for the more speedy and effectual punishing the rioters,” was enacted by Parliament in 1715. Before arresting persons under this law, the law had to be read aloud, allowing people to disperse and to assure that they knew they were in violation of the law.

People talk of the death penalty being in the bible as a justification for capital punishment. But how was the biblical death penalty enforced back then? It was only invoked after a series of requirements were met – chief among them the criminal had to have been told in front of two witnesses that what he was about to do was indeed punishable by death.

People have to know before being held culpable.

Even the mythical Jesus of Nazareth said, “Forgive them for they know not what they do.”

Well I am putting Withers on notice: If you are With ➡︎HER then you side with murder and death on a global scale.

Hillary Clinton’s stated Raison D’être, from her own mouth, for being the president is to be able to launch war to ATTACK and DESTROY countries she sees as led by “bullies,” a mind-numbingly jejune attitude for an elderly woman to have. It reeks of the schoolyard she must have dreaded as a child.

As Secretary of state, Clinton’s bloodlust and eagerness to fight anyone she perceives as a bully led to the massacres in Libya, and Syria, and Honduras. And she refuses to acknowledge it. Worse, she DEFENDS it.

This is who Hillary Clinton is. A neocon warrior who will plunge the world into more wars. Neocon Republican Robert Kagan said to the NY Times in 2014: “I feel comfortable with her on foreign policy,” Mr. Kagan said, adding that the next step after Mr. Obama’s more realist approach “could theoretically be whatever Hillary brings to the table” if elected president. “If she pursues a policy which we think she will pursue,” he added, “it’s something that might have been called neocon, but clearly her supporters are not going to call it that; they are going to call it something else.”
This praise is from the neocons who planned her run for years while you Withers were not paying attention. As the NY Times discovered in 2014. The people who needlessly invaded Iraq and Afghanistan – where America STILL wages war to this very day are WITH ➡︎HER.

She is a neocon. Why do you suppose almost all the G. W. Bush team endorses her? Because they like change and peace?

Where Hillary Clinton gets her deep need to fight and destroy, whence her fixation with seeing bullies under her bed, I leave that to the psychiatrists she should have had treating her over the course of her life. But there is a clear sickness there. And for the world, there is stark  danger.

As the late-Christopher Hitchens cogently noted in 2008: “As for Mrs. Clinton, as for all she’s done for us and after all she’s suffered on our behalf, she feels she’s owed the presidency and who could possibly disagree? Her life is meaningless if she doesn’t get at least a shot and one can only sympathize. Unless you think, as I do, that people should be distrusted, who are running for therapeutic reasons,” said Hitchens. “Because the Presidency doesn’t calm those demons, as her husband has already proved.”

Hillary Clinton NEEDS war. Fighting is central to her stated image of herself. Fighting defines her. She is a HAWK who quotes Reagan at every opportunity.

Last night in a softball TV interview on being Commander-in-Chief, Clinton said she will destroy Syria through air power.

Vote for her and you support that.  Period.  There is no wiggle room.

NO MORE UNCONSTITUTIONAL WARS OF CHOICE.

If you support Hillary Clinton, you support wars.

And more wars.

Your vote will say it is just fine with you. Hillary will use YOUR vote to claim a mandate. Then she will attack.

And the blood of innocents will be on your hands.
Not mine.
I will never support any conservative war-hawk.
You have been warned.
You have no excuse now.
This is the Riot Act.

Why Are People Afraid Of Being Wrong?

If I had to isolate one personality characteristic most common in Social Media, it has to be FEAR.

Fear is not evident in everyone (especially not in those on my friend list!) but it sure is out there and running wild. Fear of damn near everything is bad enough – but mostly in chats I have observed a strange fear of being WRONG about something. For example, one person on Facebook just BLOCKED me after sending a snotty message because I DARED to mention that contrary to her assertion, New York’s Lincoln Center is not located on 68th Street. This demonstrable fact upset her. Why? I have no idea, but her reaction is not atypical.

I recently listed FBI stats in a NY Times comment section (the lowest form of Social Media) showing that terrorism in the USA is mostly non-Muslim. “Uh, NO!” came one brilliant reply from a master of forensics.

I have repeatedly asked Hillary supporters to give me one reason SHE should get any votes. If a specific reason is ever cited, a rare happening, it always turns out to be wrong – which I gracefully explain using a new invention called FACTS. Invariably, these facts are dismissed with a wave of the phrase “you are a hater!” and then I am usually compared to a lower bodily orifice. Why? Because a cherished belief turned out to be wrong. To Hillary supporters, merely correcting their mistakes about her record is like asking a jesus-christer if Mary really was a virgin.

BEING WRONG IS NOT A SHAMEFUL THING

Acknowledging an error, and acknowledging ignorance, is the first ESSENTIAL step in the process of LEARNING. Yet time and again we see people who have false beliefs which they cling to in spite of facts. This is evidence of fear, and when fear takes hold, facts mean nothing.

We are ALL ignorant concerning many things. How could it be otherwise?

Does anyone seriously think they know everything? Yet the words “I do not know” seem to be the most difficult things for many people to string together. Rather than say “I do not know”, they will fabricate “facts.” Then, they cling to the fabrication with religious zeal. They simply cannot tolerate being wrong. This is where the lie that 99% of terrorists are Muslim comes from.  Prove this is wrong, which is easy, and all hell breaks loose.

Why is this? I don’t know many more things than things I do know. How could it be otherwise? Yet people go to war over the supposed SHAME of being wrong about something. They not only refuse to acknowledge an error, they double down. They act just like Bush/Cheney/Powell on the subject of WMD (and STILL people insist that there WERE WMD even though “W” once slipped up and admitted otherwise.)

Think of Donald Drumpf clinging to his demonstrably erroneous belief that thousands upon thousands of Muslims over in Jersey City cheered on 9/11/01. Or that Paris is a city in Germany.

This is part of Drumpf’s appeal to a generally disturbed public. He is simply incapable of acknowledging a mistake. And he is cheered for this ignorant intransigence as though it were an asset. He also must be keenly aware that if he does say he was wrong he will lose his most ardent – and ignorant – supporters. They would turn on him faster than Drumpf can bankrupt a casino.

Putting fear-based people in positions of authority will always lead to death and destruction on a global scale. Until America rids itself of fear, people exactly like “W,” who live in constant fear (as do most dry drunks), will hold a deep appeal to voters. Look at the millions of deaths and the widespread destruction “W” caused in his panic over supposed “evil doers” he saw everywhere.

This is not Bush’s fault, nor is it Drumpf’s fault. Sick people will always elect other sick people. It is inevitable. And the sickest among us will never seek help, for in our culture “YOU SHOULD HAVE YOUR HEAD EXAMINED” is a deep, deep insult. When you break a leg, is: “YOU SHOULD GET THAT X-RAYED” an insult? No, nor should it be.

Sick people whose addiction is fear will never let go of that fear. They need it. They are accustomed to it. It is in the warp and woof of their personal fabric, planted there ages ago and nurtured with all the loving care an addict always give to their drug of choice.

This fear is nothing new. 1919 was a year of monumental fear in America – and that is when this book was written. It sure resonates today.

Election Time Is America’s FEAR-A-PALOOZA

Crime is down in America. Despite this fact, a new report from the Brennan Center for Justice at NYU School of Law just found that Americans are terrified of crime. 
70% of Americans believe that they are in danger of being killed by “ISIS” – which they think is trying to take over America. International Terrorism is a chimera; a fantasy drilled into the consciousness of Americans by politicians who use this demonstrably false threat to hold power. The BBC documentary THE POWER OF NIGHTMARES charts this fraud in great detail. It works and now the HOME OF THE BRAVE is quaking in its boots. Even though home-grown followers of a reputed Prince of Peace have been bombing and shooting up Planned Parenthood centers, nebulous “foreigners” are feared to the marrow.

Even though more toddlers have killed Americans than terrorists have, the fear of foreign terrorists is pervasive and forms the basis of the Republican political campaign.

Listening to the hysterical shrieking of the conservative fear-mongering horde, one would never know that you are more likely to be crushed to death by your furniture, than killed by terrorists.

People deliberately spreading fear… THEY are the real terrorists. The only people terrorizing you now are these power-hungry politicians.

There is a candidate on the Democratic side who also talks the neocon bull about the need for America to lead the world in  “the global fight to exterminate Islamic State” which presents NO threat to us here. Mrs. Clinton even calls for a NO FLY ZONE even though ISIS has no air force. Or a single airplane.

When trying to persuade people to vote for her, as they ignore the many serious complaints about her, Mrs. Clinton’s supporters always whip out yet another fear: They say we MUST have her in office to save the Supreme Court.  So even though they admit that she cannot be trusted in other ways, and she talks like a conservative, and is sponsored by Wall Street (which shovels money at her) they somehow trust her to make progressive SCOTUS choices. Why? And said from he court, what are we to expect from her choices to run The Fed? The Commerce Department? The FDA? The Treasury Department? The SEC? The Education Department? Will she secure the separation of church and state? When it comes to the mythical man in the sky, Mrs. Clinton is as much a bible thumper as any other conservative, claiming that this amalgam of Bronze Age fairy-tales made her the person she is. Religious pandering always accompanies fear mongering with conservatives and Mrs. Clinton is no exception.

Back to earthly matters: Will Clinton protect Social Security from Wall Street privatizing? Will she prosecute the rapacious banksters who crashed the economy of the world? Yes, you say? Why should we think so? This would be biting the hand that feeds her, and feeds her husband, and feeds her daughter, and feeds her much touted grandchild – whose father is a hedge-fund huckster from a family of Republican politicians.

And when all else fails, the Clinton wing raises the fear of back-alley abortions – claiming she and she alone will save Roe v. Wade.  See my previous post in this blog in which I show why that is balderdash. This is more fear… It is all some people have to offer. Some. Not all…

So clearly, we cannot lay the far-mongering rap exclusively on the Republicans. It infects conservatives no matter which party they sign on with. One thing is certain: I will never support any candidate who inspires and exploits fear. THAT is terrorism: “the use of violence and intimidation in the pursuit of political aims” (New Oxford American Dictionary). And deliberately scaring the crap out of people is intimidation. Doing so for political gains is TERRORISM. No, it is not swarthy, Muslim, foreign terrorism but terrorism it is.

Using fear is, of course, nothing new. The whole phony “Cold War” worked wonders in the fear department. I hear from people to this day who believe that “commies” are trying to take over America – which was another totally phony fear. The USSR was never a threat to America. Again, see THE POWER OF NIGHTMARES to learn how Ronald Reagan whipped this fear up to a post-McCarthy fever pitch even though the CIA told him it was baloney. The CIA. Hardly a bastion liberal pinkos… For a look at fear in the early 20th Century I recommend the reissue of a 1919 classic called UNMASKING FEAR.

True Humility

Since humility and humblosity are in the news this week,
I recall a Buddhist story worth repeating.
A rich, powerful warlord approaches the master and asks, “Master, what is humility?”

The master looks the warlord up and down then says, curtly, “And just who on earth are you to waste my precious time with your insignificant, foolish, and childish questions?”
The warlord trembles with rage and as he pulls out his sword, the master says, “What you are feeling now. That is NOT humility.”
And the master walks away.

SEPARATION OF CHURCH & STATE? IT’S IN THE BIBLE! (again)

I posted this back in 2012, but with the hypocritical ignoramuses in the republican party (formally called “candidates”) howling about “religious freedom” and how it trumps the Constitution, I thought it time to revive it. These bigoted loudmouths know nothing of their beloved bible.

     It is the religious right wing loud mouths who always can be counted upon to a) demand that we obey the Holy Bible and b) make the claim that there is no such thing as separation of Church & State in America because those words are not in the Constitution. Never mind that this separation was primary on the minds of those who wrote the Constitution. Forget that this separation is what made the United States of America absolutely unique in the history of Western “civilization.” And the hell with the facts that the United States Supreme Court has consistently held that such a separation exists. Throw all that away if you wish.  Let us see what the Bible itself has to say on the subject:

     As Moses is ready to die and the Israelites prepare to enter the Promised Land, Moses grows concerned that there the tribes have no leader to keep the people from anarchy. So, being Moses, he consults God. Here is what happens in the King James Version of the Holy Bible:

Numbers, 27:15-23

And Moses spake unto the LORD, saying,

Let the LORD, the God of the spirits of all flesh, set a man over the congregation,

Which may go out before them, and which may go in before them, and which may lead them out, and which may bring them in; that the congregation of the LORD be not as sheep which have no shepherd.

And the LORD said unto Moses, Take thee Joshua the son of Nun, a man in whom is the spirit, and lay thine hand upon him;

And set him before Eleazar the priest, and before all the congregation; and give him a charge in their sight.

And thou shalt put some of thine honour upon him, that all the congregation of the children of Israel may be obedient.

And he shall stand before Eleazar the priest, who shall ask counsel for him after the judgment of Urim before the LORD: at his word shall they go out, and at his word they shall come in, both he, and all the children of Israel with him, even all the congregation.

And Moses did as the LORD commanded him: and he took Joshua, and set him before Eleazar the priest, and before all the congregation:

And he laid his hands upon him, and gave him a charge, as the LORD commanded by the hand of Moses.

    Do you get what happened? Moses puts Joshua in charge of the people and has Aaron’s son Eleazar in charge of the priesthood. Moses and, more to the point, GOD ALMIGHTY have vested two separate people with the powers of Church & State. It is right there in the Good Book.  Joshua is in charge of the people and Eleazar is in charge of tending into God’s judgment. It’s all there in black and white.

    As long as the religious literalists insist that the Bible is a history book, and as long as they insist that it is God’s “divine plan” for humanity, silly claims but they make them nonetheless, then we see by example that God wants the power of the state separated from the power if the religious establishment. There is no getting around it.

    UPDATE: Further driving the point home is 1 Samuel, 13:8-14 where King Saul, tired of waiting for the arrival of Samuel the priest, makes his own burnt offering. When Samuel arrives all hell breaks loose. Why? Because Saul has usurped the power of the clergy and thus violated the biblical separation of Church & State.
Can it be any more clear?
